Terms and conditions

1. Scope and seller

These terms apply to contracts for photo prints between consumers or businesses and ROTE PLACE®, owner Robert Seemann, Lombardeiweg 2, 91325 Adelsdorf, Germany.

2. Product

Selected original photographs are offered as direct photo prints on Alu-Dibond in the standard sizes stated on the website. Prints are produced to order by a professional photo laboratory only after payment has been received.

On-screen images are previews. Minor technical differences in colour, brightness, crop or material appearance may arise from display devices and the production process. Statutory rights in respect of defects remain unaffected.

3. Enquiry and conclusion of contract

The presentation of the photographs and prices on this website does not constitute a binding offer to enter into a purchase contract. The “Purchase enquiry by email” function merely submits a non-binding enquiry. A purchase contract is concluded only after ROTE PLACE® has sent the interested customer a binding offer by email and the customer has expressly accepted that offer by email.

The terms and withdrawal information are supplied with the binding offer in text form or reproduced in full in the email so they can be saved before the customer makes a binding declaration.

4. Prices and delivery charges

The total price stated in the binding offer applies. Standard delivery within Germany is included in the published standard prices unless the individual offer states otherwise.

All prices are total prices including the applicable statutory VAT.

5. Payment and production

Payment is made in advance by bank transfer to the account specified in the offer or invoice. Production is commissioned only after full payment has been received.

6. Delivery

For standard orders within Germany, the stated delivery time is generally 7–14 working days after full payment has been received unless the binding offer specifies a different delivery time.

7. Consumer withdrawal rights

Consumers generally have the statutory right of withdrawal for distance contracts. Details are set out in the separate withdrawal information. Producing a regular standard print only after the order is placed does not by itself remove that right.

8. Genuine custom-made items

Custom sizes, individual crops or other customer-specific versions may be offered by separate agreement. If a statutory exception applies because production is materially determined by an individual customer specification or the item is clearly personalised, this will be stated expressly before the contract is concluded.

9. Return costs following withdrawal

Where a consumer validly withdraws, the consumer bears the direct return costs if properly informed before the contract is concluded. For standard sizes that can be returned as a parcel, a prepaid return label can be supplied on request for €6.90; alternatively the customer may arrange return delivery at their own cost.

If a size cannot normally be returned by post, the estimated direct return costs will be stated separately in the binding offer before the contract is concluded. The €6.90 amount does not automatically apply to oversized goods.

10. Defects

Statutory rights in respect of defects apply. If a defect is alleged, the seller should first be contacted at robert@theorderedeye.de so that the next steps can be coordinated. This does not restrict the customer’s statutory rights.

11. Copyright and usage rights

Purchasing a print transfers ownership of the physical print only. Copyright and other usage rights in the underlying photograph are not transferred. Reproduction, editing, publication, making available to the public, redistribution or commercial or advertising use requires the prior express permission of Robert Seemann unless the use is permitted by law.

12. Consumer dispute resolution

The seller is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body. Statutory information duties after a specific dispute has arisen remain unaffected.

13. Governing law

German law applies. For consumers, this choice of law does not remove mandatory consumer-protection provisions of the country in which the consumer has their habitual residence.
